Domestic Violence: Its Impact on Parental Abduction, Custodial Interference & Parental Alienation __
A left behind parent faces many obstacles to recovering their child when experiencing domestic violence, custodial interference, parental alienation and parental abduction. Often the left behind victim doesn’t know where to turn especially when they are further traumatized by the legal system or manipulated by the batterer themselves during a custody dispute. Due to my personal experience, regarding domestic violence, custodial interference, parental alienation, and parental abduction, it has persuaded me to advocate for such an important cause such as “A Lost Child Prevention Campaign, One Child At A Time.” Upon entering, agreeing, and establishing a stipulation as to custody and child support of my own minor child, there was mutual consent and a court ordered written plan of care between myself and the other party. I am the party the Court granted as the legal, physical and residential custodian of my minor child. I initially made the offer regarding my minor child’s best interest and the other party accepted the offer. There was no counter offer nor was the offer rejected by the other party. There was an exchange amongst us regarding my minor child’s best interest. The other party violated an original court order that was set up until my minor child reached the age of 23 years old. The other party divorced me years later initiating a different court case with a conflicting case number. The other party by and through his Attorney knew about those original orders but ignored and disregarded them even though they both acknowledged them with their signatures. During my research, I recently learned that in the state of Colorado, violation of a custody order occurs when the elements of the crime of the violation of custody is met. I further researched an affirmative defense to the crime of violation of custody. “ Although, the time lost between my child and I can never be replaced, the emotional, physical, verbal and financial abuse inflicted upon myself by the other party is only a distant memory. I aim to reduce the time an endangered, missing child is missing, potentially saving a child’s life, therefore reducing the anquish and distress a left behind parent feels. I am fully committed to assisting in the global search for endangered, missing children and dedicated to helping left behind families find their loved ones. Furthermore, it is important to me to further my education to so I gain the legal knowledge and expertise to fight this troubling trend of domestic violence impacted by parental abduction, and parental alienation. Unfavorable outcomes affect the left behind domestic violence victim when a criminal justice system fails to respond promptly and effectively when there is custodial interference or when the children are abducted. A favorable response is one that is tailored to an individual’s case to prevent custodial interference and parental abduction when a valid custody order has been established to prevent parental abduction. When an abductor is a batterer, law enforcement's efforts to locate the children and return them to the non-violent parent and prosecution's filing of criminal charges may protect children and help prevent perpetrators from misusing the legal system to continue a pattern of domestic violence through endless harassment. When a domestic violence victim has fled with their children, however, the same response may not serve the ends of justice or make a child feel safe. Parental abduction devastates left behind families across the nation. I find from observing cases that make the news, domestic violence underlies many of the most tragic parental abduction cases. In a domestic violence case, a parental abduction occur in one of two distinct categories: The perpetrator of domestic violence take the child(ren) in order to further harm their victims or the domestic violence victim flees with their child(ren) in an effort to protect themselves and their children from the perpetrator of domestic violence. Despite the dramatic difference between the two parental abductions- one is being vindictive and the other being protective. The criminal justice system rarely considers the context or reasoning behind the abductions. The criminal justice’s response to a parental abduction is the same for a perpetrator or a victim of domestic violence, regardless of reasoning and rationale why the parent left with their child(ren). In conclusion, parental abduction will be prevented only when early intervention by our justice system avert the risks posed to children and their parents or legal guardians in the context of domestic violence and the threat of parental alienation that leads to parental abduction. Providing further education and preventative efforts provides safety measures for at risk parents and their children who may be victimized through the intensified trauma of a parental abduction.
