Not to bring down your idea, but are you allowed to use the Marvel name & Spiderman franchise? They lock down their material very well and we personally don't feel this would classify as a fan film or fair use of the material?

Beth Fox Heisinger

Two words: Copyright Infringement.

Beth Fox Heisinger

And some more words: Registered Trademark. Intellectually Owned Property.

Beth Fox Heisinger

Ryan, develop your own character and world. Do something original. Make it yours. ;)

Beth Fox Heisinger

And if you cannot afford $$$ to risk $$$, then don't risk getting sued. Lol! ;) Sorry, but this does not fit into "fair use." Nor is it parody.

Beth Fox Heisinger

Speaking of parody and YouTube... Look at "BatDad." This guy makes these funny little clips wearing a simple, over-the-counter, plastic, elastic strap, Halloween, Batman-like mask, doing daily tasks as a parent. And he does a damn good Christian Bale Batman voice too. Lol! He films with his phone and edits on his laptop computer. What's hilarious is his family putting up with his antics. Anyway, he's doing pretty damn good... There're BatDad Vines... Got a mention on national news... Even a mention in the latest Lego Batman movie. Released a book... ;)

To Who Is Concern About this ... I Understand , Trust Me , But This Is A FAN FILM .....Again FAN FILM but A Long One Too. I Know That A Film Festival will Not Accept This But Mabey My Outer Projects will. And I Will Not Be Harassed Of what I Need To do Its My Project . If Something Goes Wrong I'll Fix It . Dan MaxXx Beth Fox Heisinger

Beth Fox Heisinger

Ryan, this is not harassment. This is talking about reality and legal fact: Marvel owns this property. From what you describe, what you wish to do, it may not be considered "fair use." Plus you're posting on a public website about committing potential copyright infringement.... So the concern is yours. We're actually trying to help you. With that, I wish you luck. :) Cheers!

Ryan Peters

How Will It Be Bad If I Use It On YouTube? Because I see outer spider-man Fan Films on Youtube. Beth Fox Heisinger

Beth Fox Heisinger

Ryan, copyright infringement happens all the time on YouTube... There are all kinds of YouTube lawsuits. Learn what "fair use" means, what is and what is not okay. :) Best to you!

Doug Nelson

Look up Mellisa Hunter and ask her about her Adult Wednesday Adams series.

Evelien And Dorien Twins

Dan MaxXx that PR fanfilm was awesome! However there was a pending legal action, and the project was removed from the streaming sites (VIMEO/YOUTUBE/....) prior to them actually being allowed. We assume the large backlash had something to do with them ultimately being allowed to have it online anyways.

Beth Fox Heisinger

Melissa Hunter's series was taken down, off YouTube for copyright infringement. ...Sometimes it depends on how the IP owners feel about fan stuff, where they draw the line. Or other misuses of property being used without permission can also get you in legal trouble. Some documentary about Stanley Kubrick faced a lawsuit for music used without permission, I believe? Anyway, with Marvel I'd be careful. ;)

Jean-Pierre Chapoteau

I know some people that shot an entire spiderman webseries here in atlanta. Fan made. It has over 500,000 views. Not sure about people actually getting sued over fan stuff. Maybe a handful? I've seen tons and tons of anime adaptations on youtube. I'm assuming they'd have a problem with it if you have something that actually challenges their version, which I doubt most indie filmmakers have the money for.

I say go for it, bro.

Beth Fox Heisinger

Here's an objective article that may help decipher the messy world of fan art and copyright. It gives some thoughtful tips on how to steer clear of any possible problems: https://www.plagiarismtoday.com/2010/05/13/the-messy-world-of-fan-art-an....

Beth Fox Heisinger

Also, just for the hell of it... I checked Marvel's website and they do have a statement asking anyone who sees something that may be trademark/copyright infringement upon any of their properties to please report it, and they give a specific email address just for that purpose. It seems they are very concerned with someone profiting from illegal use, illegal merchandising, selling fan work/films, etc. So.... I dunno, I think it would be smart to peruse their site, see their policies for fans. With soooooooo many popular Marvel characters... And the slew of new Marvel films coming out... And their massive fan base who dearly love their characters... I'm sure they have some sort of line or policy for tolerance. So it would be smart to know that line. Of course if you stay within "fair use" you should be fine. :)

Doug Nelson

Beth - that was my point - that Melissa got slapped - I think Ryan ought to consider what he's doing carefully..

Beth Fox Heisinger

Doug, agreed. ;)
