How exactly do mean reference them? If you are using it as an example in character description you're ok without permission. An odd hand reference between characters like "Who does he thing he is? Bruce Willis or something?" should also be okay.
no, that is a producer's job... if the screenplay ever goes into dev/production. I think folks buy errors & omissions policies for that, and there are plenty of fantastic unauthorized writing biopic samples (specs). A well-known writer paid $1000 to skater Tonya Harding for her life rights but I don't think the other real people in Tonya's life received any $.
