EVA & IGNACIO: AN ADOPTION STORY

EVA & IGNACIO: AN ADOPTION STORY
By Timothy Swiney

GENRE: Drama
LOGLINE: Based on a true story. A same-sex couple must fight a conservative judge, a crooked lawyer, and a conniving aunt in order to adopt their two young foster children and become the first same-sex couple to jointly adopt in Georgia.

SYNOPSIS:

At only six weeks of age, baby Eva was brutally beaten and left for dead by her parents. Abandoned in the emergency room along with her 15 month old brother and with no family available, both children were placed in foster care and available for adoption. Due to Eva's severe injuries, finding an adoptive family was difficult until Tim and Eric, a long term foster couple, decided to adopt the children. Almost two years later, as the final adoption draws near, a deeply religious court appointed Guardian ad Litem intervenes. Believing that the children would be better off in a more traditional home, the Guardian contacts a distant relative and convinces her to petition for custody of the children. As a result, Tim and Eric are faced with a lengthy legal battle to keep their children. The conservative judge disregards the law and appears to favor placing the children with a single-mother of six children living on government assistance rather than approve the adoption of a same sex couple. While the distant relative and the Guardian ad Litem are allowed every legal courtesy by the judge, Tim and Eric are denied legal representation and are refused to even be heard in the courtroom. With the deck stacked against them, the couple's only hope of saving their family rests with an overworked DFACS attorney and a disorganized case worker. During the course of the hearing, the DFACS attorney is able to expose the bigotry within the court system and to mount a legal challenge that leaves the judge no legitimate or legal reason to deny custody to the foster parents. In the end, Tim and Eric become the first same-sex couple to jointly adopt within the State of Georgia.
